Terms and Conditions for Recruiters and Employers

These terms are a contract between CapriTech Global Services LLC, [EDIT: registered address], [EDIT: US state], USA, EIN [EDIT: EIN] ("OHCjob.com", "we", "us") and the company or organisation on whose behalf you register ("you", "the Company"). The person who registers confirms they are authorised to bind the Company. These terms include the Privacy Policy, Refund and Cancellation Policy and the Data Processing Terms in section 11.
1. Eligibility and verification
1.1 The Company must be a genuine occupational health service provider, hospital, staffing firm or employer with its own occupational health centre, located outside the European Union, EEA, United Kingdom and Switzerland, and not in a country subject to comprehensive sanctions (section 9).
1.2 Every Company is verified before any job goes live. You must provide: a work email on the Company's own domain (free webmail only with extra documents), verified email and mobile; business registration or trade licence; tax registration (GST certificate, UAE TRN, US EIN letter or local equivalent); website and LinkedIn company page; and the name and designation of an authorised person who will confirm the account on a call or video call with our team. We also run automated checks (domain age, website reachability, email-domain match, duplicate detection, sanctions screening, disposable-email block).
1.3 We may approve, request more documents or reject at our discretion, and we re-verify every 12 months or on any change of ownership, name or domain. While pending, you can draft jobs but they are not published.
1.4 You must keep your Company details, authorised persons and team members current, and remove team members who leave.
2. Job postings
2.1 Genuine vacancies only. Each posting must describe a real, currently open occupational-health position for which the Company (or its named client, for staffing firms) is actively hiring. No "CV-collecting" posts, no bait-and-switch, no posts for jobs already filled.
2.2 Mandatory salary disclosure. A salary range (minimum and maximum, currency and period) is required on every job and is shown publicly. It must reflect what you actually intend to pay.
2.3 No fees to candidates — ever. You must not charge, or allow any agent to charge, a candidate any fee, deposit, "processing charge", training fee, uniform charge, visa cost recovery or similar amount in connection with a vacancy on OHCjob.com. You must not retain a worker's passport or original documents. This reflects the ILO Employer-Pays Principle and the laws of India (Emigration Act, 1983), the UAE, Saudi Arabia, Qatar and others. Breach leads to an immediate permanent ban and referral to the authorities.
2.4 No discrimination. Postings must not exclude candidates by religion, caste, race, ethnicity, sex, marital status, pregnancy, disability or age except where a genuine, lawful occupational requirement exists (for example a statutory age limit for offshore work). Nationality requirements may be stated only where visa or licensing rules genuinely require them.
2.5 Content rules. No misleading titles, no personal email or WhatsApp-only contact instructions, no requests to pay or to contact an off-platform agent, no copied text from other listings, no content that infringes third-party rights. Jobs are moderated before publication until the Company has five approved jobs without reports, and randomly audited afterwards. Three public reports pause a job automatically pending review.
2.6 Removal. We may edit, pause, reject or remove any job that breaches these terms or the law, and we may remove all of a Company's jobs and ban the Company where fraud is found, without refund. Applicants to removed jobs are notified.
2.7 Each job stays live for 30 days (renewable using another post from your plan). Duplicate near-identical posts for different cities must use the multi-location option rather than separate listings.
3. Plans, prices and limits
3.1 Prices are in US dollars only, charged once for a 1-year term, worldwide. There is no monthly billing and no regional price list. Current plans (subject to change for new terms; your purchased plan keeps its terms for its year):

3.2 Unlocks: one unlock reveals one candidate's contact details and CV and remains available to the Company for 12 months. Applicants to your own jobs never cost unlocks. Daily caps on CV downloads and unlocks apply (default 100 per Company per day) to prevent bulk extraction.
3.3 Expiry: unused posts, unlocks and featured credits expire at the end of the plan year. Upgrades: any time, with pro-rated credit for the unused part of the current plan. Top-ups: extra posts, unlocks and featured jobs may be bought on any paid plan. Coupons, trials, launch offers and referral rewards are subject to the conditions shown at the time and may be withdrawn for abuse.
3.4 Taxes. Prices exclude taxes. Invoices are issued by CapriTech Global Services LLC (USA). Where your country applies reverse-charge VAT/GST on imported services (for example India GST, UAE VAT), you are responsible for self-assessing it; we print your tax ID and, for India and Gulf customers, a local-currency equivalent and the exchange rate as an informational line. Stripe Tax may collect tax where we are required to.
3.5 Payment. By card through Stripe. Auto-renewal is off by default; where enabled for your country you may cancel it in the billing portal before the renewal date. Unpaid manual invoices do not activate a plan.
3.6 Refunds are governed by the Refund and Cancellation Policy: full refund within 7 days if nothing has been used; no refund after any post, unlock or feature has been consumed; fraud-based removal is never refunded.
4. Team members
The Company is responsible for all actions of its owner, admins, recruiters and viewers. Seats may not be shared between people. Billing is restricted to owner and admin roles.
5. Verified badge and Company page
After verification the Company receives a public page and a "Verified employer" badge. The badge states that we checked the Company's documents and identity; it is not an endorsement of the Company's practices. We may withdraw it at any time.
6. Applicant management and messaging
Messages to candidates must relate to the vacancy. Interview details you enter are sent to the candidate on your behalf. You must respond to candidates' data-related requests (section 11) and must not contact candidates who have blocked you.
7. Compliance with recruitment, labour and immigration law
7.1 You are solely responsible for complying with the labour, immigration, anti-trafficking, licensed-recruitment and professional-licensing laws of both the country where the job is located and the country of the candidate. Examples: India's Emigration Act, 1983 and eMigrate system (foreign employers must register on eMigrate and, for ECR countries and for nurses, recruit through a Registered Recruiting Agent; the fee to the worker is capped by law); UAE MoHRE licensing; Saudi Musaned/Qiwa; Qatar Ministry of Labour approvals; DHA/DOH/SCFHS/QCHP licensing eligibility; US state licensure and visa sponsorship rules.
7.2 If you are a staffing or recruitment agency you confirm you hold every licence required in the countries you recruit from and to, and will provide licence numbers on request.
7.3 You will not use the Platform to recruit for jobs in, or on behalf of entities in, countries on our sanctions screen list, or in a way that would breach US (OFAC), Indian or other applicable sanctions and export-control laws.
7.4 You confirm the Company does not use forced or child labour and complies with occupational safety law at the workplaces it recruits for.
8. Acceptable use and platform integrity
You must not: scrape, crawl or bulk-download candidate data; share your login or resell access; post jobs on behalf of unrelated third parties without disclosure; use candidate data for any purpose other than section 11; interfere with security, rate limits or verification; or disparage candidates publicly.
9. Sanctions
We screen Companies, jobs and candidates against a country list maintained in our systems (currently including North Korea, Iran, Syria and Cuba) and may block postings from or to further countries as law requires. You warrant that neither the Company nor its owners are sanctioned persons.
10. Audit rights
We may ask you, with reasonable notice, to confirm how you have used candidate data received from the Platform, to produce your eMigrate/agency licence details, and to evidence that no fee was charged to any worker. Failure to cooperate is grounds for suspension. We may also contact candidates you hired to confirm that no fee was paid.
11. Candidate data: Data Processing Terms
11.1 Purpose limitation. Candidate personal data you receive through the Platform (applications, unlocked profiles, CVs, messages) may be used only to evaluate and recruit that candidate for the Company's own occupational-health vacancies or, for staffing firms, for the specific client vacancy the candidate applied to or was unlocked for.
11.2 Prohibited: selling, renting, licensing or otherwise transferring candidate data to any third party; adding candidates to any marketing list or sending them promotional messages; scraping or bulk export beyond your plan's features; using data to build your own database or to train AI models; contacting candidates for non-recruitment purposes; using data after the recruitment for that vacancy has ended, except as required by law.
11.3 Independent Data Fiduciary. For the candidate data you receive, the Company is an independent Data Fiduciary under the Digital Personal Data Protection Act, 2023 (India) and the equivalent role under any other applicable law. You are responsible for your own lawful basis, notices, security and for responding to candidates' rights requests about the data you hold.
11.4 Security and retention. Keep candidate data confidential and secure with technical and organisational measures appropriate to its sensitivity; limit access to staff who need it; delete it when the vacancy is closed and any statutory retention period has passed, and in any case within 12 months of receipt unless the candidate was hired.
11.5 Candidate requests. Delete or correct a candidate's data within 7 days of their request (or ours on their behalf) and confirm to us.
11.6 Breach notification. Notify privacy@ohcjob.com within 24 hours of becoming aware of any unauthorised access to, or loss of, candidate data received from the Platform, with details sufficient for us to notify affected candidates and regulators.
11.7 Indemnity. You indemnify and hold harmless CapriTech Global Services LLC, its officers and staff against all claims, fines, penalties, losses and costs (including legal fees) arising from your breach of this section 11, of section 2.3 (fees to candidates), of section 7 (recruitment and immigration law) or of any data-protection law in relation to data received from the Platform.
12. Intellectual property and your content
You grant us a worldwide, royalty-free licence to publish, syndicate (including to job aggregators and social networks), cache and reproduce your job postings, logo and company description for the purpose of operating and promoting the Platform. You warrant you have the rights to the content you post.
13. Suspension and termination
13.1 We may suspend or terminate the Company's account immediately, without refund, where we reasonably believe there has been fraud, a fee charged to a candidate, a breach of section 7, 9 or 11, repeated policy violations, non-payment, or a legal requirement. Where the issue is minor we will normally warn you first.
13.2 You may close your account at any time from the recruiter settings. Closure does not entitle you to a refund beyond the Refund Policy. Financial records are retained as tax law requires.
13.3 On termination you must delete candidate data received from the Platform except as law requires you to retain it.
14. Warranties and liability
14.1 The Platform is provided "as is". We do not warrant that any candidate will apply, that candidate information is accurate (we verify licences and documents but candidates remain responsible for their own information), or that the service will be uninterrupted.
14.2 Our total liability to the Company for all claims in any 12-month period is limited to the fees paid by the Company to us in that period. We are not liable for indirect, consequential or special loss, loss of profit, loss of business or loss of data.
14.3 Nothing limits liability for fraud, wilful misconduct, or where mandatory law does not allow limitation.
15. Changes
We may change these terms and the plan catalogue. Changes to prices or limits apply from your next purchase; other material changes are notified in the recruiter dashboard and by email and require re-acceptance at the next login.
16. Governing law and disputes
These terms are governed by the laws of the State of [EDIT: US state], USA. The state and federal courts located in [EDIT: county, state] have exclusive jurisdiction, except that we may seek injunctive relief in any court to protect candidate data or our intellectual property. Before litigation the parties will attempt to resolve the dispute through good-faith negotiation for 30 days.
17. General
Entire agreement; severability; no waiver; assignment by us to a successor; notices to the owner's email address; English language version prevails.
